Privacy Statement UBecom
UBecom processes personal data of candidates and clients who want to be included in our database.
We process this personal data in a lawful, fair and transparent manner. As required by the General Data Protection Regulation (“AVG”).
This also means that we want to inform you in a complete and clear manner with this privacy statement. However, if you have any further questions about this, please do not hesitate to contact us (see section 7).
What personal data we collect
We can process the following data from candidates: name, contact details, date of birth, place of birth, language, resume, diploma/certificate, employer details (name, address, VAT number and Chamber of Commerce number), passport and social security number and contract details.
We can process the following data from clients: name, address, contact details, company details (name, address, VAT number and Chamber of Commerce number of the self-employed person or employer), contract details.
Why we process personal data and the legal basis
UBecom processes personal data of candidates and self-employed persons to the extent necessary for the provision of its services, namely the contracting of projects and the supply of technical professionals who advise, implement and supervise multidisciplinary projects in the oil and gas industry.
In addition, UBecom processes personal data of candidates and self-employed persons for contracting and invoicing with regard to its services.
UBecom determines the purpose and means of this processing of personal data and is therefore the controller within the meaning of Article 4(7) of the AVG.
For these processing operations, UBecom invokes its legitimate interest in being able to provide and settle its services, within the meaning of Article 6(1)(f) of the AVG. This is different if the services are provided on the basis of an agreement with a candidate or self-employed person who concerns a natural person. In the latter case, UBecom processes the personal data of that natural person for the execution of an agreement, within the meaning of Article 6(1)(b) of the AVG
How long we keep personal data
We keep the data to identify the candidate and/or self-employed person for a maximum period of 24 months. Contract and invoice data are kept for seven years after the year to which the data relates.
Who we share the information with
The personal data is transparent to the employees of UBecom insofar as they need it for work in the context of the UBecom services. These employees are contractually bound by confidentiality. We only share your personal data with third parties if this is necessary for the provision of services. For example, UBecom uses IT service providers with whom it has entered into agreements that guarantee that they handle your personal data in a careful manner. These IT service providers based in the Netherlands support them in offering an online selection platform and conducting financial administration. Your data will not be transferred to countries outside the European Economic Area, so that the same protection of your personal data is offered under the AVG
How we secure your information
In view of the nature of the processing and the nature of the personal data, we have taken appropriate technical and organizational measures to protect your personal data. Insofar as we allow third parties – as referred to in paragraph 4 – to process data for us, they are also obliged to take these measures.
What are your rights
You have certain rights in relation to your personal data which are described below. To be clear, not all rights may apply to you. We will review your request at all times, as required by law. If you want to know more about this. If you wish to exercise a right, please contact us as set out in section 7.
A. Right of access. You have the right to know which information we process about you and why.
B. Right to Correction. If you believe that the information we process about you is incorrect, such as a spelling mistake in your name or an incorrect date of birth, you can ask us to correct it.
C. Right to Data Erasure. Under certain conditions, you have the right to ask us to delete your personal data.
D. Right to Restrict Data Processing. In certain situations you have the right to discuss data processing. This means that we still keep the data but no longer carry out any other processing. For example, if you believe that the data is incorrect.
The data processing is then limited until we have assessed the correctness of the data.
E. Right to Data Portability. Under certain conditions you can ask us the information that we process about you in electronic form available. F. Right to object. You can object to the processing of your personal data in connection with your specific situation. G. Right to Make a Complaint.
